Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Oompf, an application and service operated by Tomoni Labs, LLC ("we," "our," or "us"). By downloading, accessing, or using Oompf, you agree to be bound by these Terms. If you do not agree, you may not use the service.

iOS Users

If you access Oompf through the Apple App Store, you acknowledge that this agreement is between you and Tomoni Labs, LLC only, and not Apple Inc. ("Apple"). Apple is not responsible for Oompf or its content. These Terms do not conflict with Apple's Media Services Terms and Conditions.

Legal Eligibility

By using Oompf, you represent and warrant that:

  • You are not located in a country subject to U.S. government embargoes or sanctions
  • You are not listed on any U.S. government restricted or prohibited parties list

2. Description of the Service

Oompf provides AI-powered tools designed to help users practice and improve communication skills. Features may include voice recording, speech analysis, feedback on delivery and clarity, vocabulary insights, practice exercises, and progress tracking.

We may modify, improve, or discontinue features at any time without guarantee of continued availability.

3. License and Scope of Use

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Oompf solely for your personal, non-commercial use.

iOS Usage Rules

For iOS users, this license is limited to Apple-branded devices that you own or control, in accordance with Apple's Usage Rules. Oompf may be accessed by other accounts associated with you through Apple Family Sharing or similar features where permitted.

You agree to comply with all applicable third-party agreements (including wireless data agreements) when using Oompf.

4. Account Responsibilities

To use Oompf, you agree to:

  • Be at least 13 years old (or have parental consent where required)
  • Provide accurate and current account information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity that occurs under your account

We are not responsible for losses resulting from unauthorized account access caused by your failure to secure your credentials.

5. Acceptable Use

You agree to use Oompf responsibly and lawfully. You may not:

  • Upload or share content that is illegal, harmful, hateful, abusive, or violates others' rights
  • Attempt to disrupt, compromise, or bypass security or service integrity
  • Use Oompf for unauthorized commercial purposes
  • Share account credentials or subscription access
  • Reverse engineer, decompile, or attempt to extract AI models, systems, or algorithms
  • Use automated tools or scripts to access or scrape the service

We reserve the right to investigate and take action against misuse.

6. Voice Recordings and User Content

By using Oompf, you confirm that you have the legal right to record and analyze your own voice. You are solely responsible for the content you submit.

Practice recordings shorter than 10 seconds may be automatically discarded to maintain system performance and quality.

You retain ownership of your voice recordings and practice content.

7. Subscriptions and Billing (Apple App Store Only)

Oompf offers both free and paid subscription options. Paid features are available through automatically renewing subscriptions.

Billing Authority

All purchases, payments, and subscription management are handled exclusively through the Apple App Store. We do not process payments directly.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before renewal.

Cancellation

You may cancel your subscription at any time via: Settings → Apple ID → Subscriptions → Oompf

Canceling stops future renewals but does not refund unused time.

Important: Deleting your Oompf account does not cancel an active subscription. You must cancel separately through your Apple ID to avoid future charges.

7.1 Free Trials and Introductory Offers

Oompf may offer free trials or discounted introductory pricing. These offers are available once per Apple ID per subscription.

If you have previously subscribed or redeemed an introductory offer, you are not eligible again and will be charged the standard price immediately upon purchase.

7.2 Pricing Changes

To the maximum extent permitted by law, we may change subscription pricing in the future. Apple will notify you in advance where required. If you do not agree with a pricing change, you may cancel before it takes effect.

7.3 Refund Policy (Apple App Store)

All purchases are subject to Apple's refund policies.

Tomoni Labs, LLC does not issue refunds for App Store purchases. Any refund requests must be submitted directly to Apple through their support channels.

Certain jurisdictions (such as California or Connecticut) may provide additional statutory cancellation rights, which Apple applies where required by law.

7.4 Anti-Abuse and Fair Use

To protect service quality, we prohibit abusive behavior, including but not limited to:

  • Account or subscription sharing
  • Creating multiple accounts to exploit trials or promotions
  • Excessive or automated usage that strains infrastructure
  • Reverse engineering or attempting to replicate our AI systems
  • Using Oompf outputs for resale or redistribution
  • Uploading illegal, offensive, or abusive content

We may enforce this policy through warnings, suspension, termination without refund, or legal action where appropriate.

7.5 Notifications and User Responsibility

Oompf may send push notifications related to trials, renewals, or account activity as a courtesy. Notifications are not guaranteed.

If you disable notifications or fail to monitor your subscription, you remain responsible for all charges incurred.

8. Intellectual Property

Oompf, including its software, AI systems, designs, and branding, is owned by Tomoni Labs, LLC and protected by intellectual property laws.

You grant us a limited license to process your content solely to provide and improve the service. We do not claim ownership of your voice recordings.

9. Privacy

Your use of Oompf is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

AI-generated analysis may contain inaccuracies. You agree to exercise discretion when practicing sensitive or confidential content.

10. AI Disclaimer and Mental Health Notice

Oompf relies on artificial intelligence systems. You acknowledge that:

  • AI feedback may be incomplete, inaccurate, or unexpected
  • Speech recognition quality may vary
  • Third-party AI services may experience outages

Mental Health Disclaimer

Oompf is a communication skills practice tool only.

Oompf is not:

  • A substitute for therapy or counseling
  • A medical or mental health service
  • A licensed professional provider

If you are experiencing a mental health crisis, suicidal thoughts, or emotional distress, seek professional help immediately.

11. Maintenance and Availability

We are solely responsible for providing maintenance and support for Oompf. Apple has no obligation to provide support services.

We do not guarantee uninterrupted service. Temporary outages may occur due to maintenance or circumstances beyond our control.

12. Warranties and Limitation of Liability

To the maximum extent permitted by law:

  • Oompf is provided "as is" and "as available"
  • We disclaim all warranties not expressly required by law
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages

For iOS users, Apple's sole warranty obligation is limited to refunding the purchase price where applicable.

13. Indemnification

You agree to defend, indemnify, and hold harmless Tomoni Labs, LLC from claims arising out of your use of Oompf, your content, or your violation of these Terms.

14. Termination

You or we may terminate your access at any time. Upon termination, your right to use Oompf ends immediately.

Account termination does not cancel active subscriptions. You are responsible for canceling through Apple to avoid future charges.

15. Governing Law and Apple Rights

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as such.

16. Communications

By using Oompf, you agree to receive:

  • Required communications: billing, security, and account notices
  • Optional communications: product updates, tips, and promotions (opt out anytime)

17. Changes to These Terms

We may update these Terms periodically. Continued use of Oompf after changes become effective constitutes acceptance of the revised Terms.
